A Linwood man charged with child endangerment for sharing pornographic images of young girls was on federal probation for similar charges when he was arrested this week, court records show.
Brian Steven Posner's computer had more than 50 files showing girls as young as infants engaged in sexual acts, acting Atlantic County Prosecutor Diane Ruberton announced Thursday.
But it wasn't the first time Posner, now 31, had photos like that on his computer, according to his previous conviction.
In 2009, a federal investigation found multiple images and video clips of young girls in sexually explicit poses or sexual conduct, according to the complaint from when Posner lived in Ithaca, New York.That investigation began after Posner allegedly got naked inside the locker room of a local YMCA in the area designated for girls younger than 13, according to the federal complaint obtained by BreakingAC.com.
When sheriff's officers responded to the report Feb. 23, 2009 in Lansing, Tomkins County, the naked man was gone. They found him dressed at a local shopping mall, and he later admitted to being the naked man, according to the complaint.
“Posner admitted he went to the Lansing YMCA with the intent of doing something inappropriate for the means of self-gratification,” FBI Special Agent James Lyons Jr. wrote in the complaint.
Posner told the agent that, while at the YMCA, he “entered multiple showers where girls under 13 years of age were showering” and had inappropriately touched “a minor child in the Ithaca, New York area, and a minor child in New Jersey,” Lyons wrote.
Posner also admitted to having child pornography on his computer, and gave investigators written consent to search his home computer. Investigators found not only videos and images, but also file names that indicated the girls' ages and sexual acts. These "text fragments" indicate girls as young as 7.
Posner pleaded guilty June 16, 2009, to one count of receiving child pornography and served about 38 months of a 60-month sentence. His supervised release was to last 10 years. Posner was required to register as a sexual offender, but there is no listing for him on the online Megan's Law registry for New Jersey. He has not been charged with anything relating to that at this time.
Now, it has been transferred from New York's Northern District for assignment to a New Jersey judge, according to a letter from the senior U.S. probation officer.
Posner had his first court appearance Friday via video from the Atlantic County Justice Facility, where he is being held on $100,000 full cash bail.Municipal Court Judge Henry Warner read the charges to Posner in Central Judicial Processing Court.
